Heavy Equipment & Marine Purchasing & Export Service Terms

TSURUGI Inc.

1. Service Scope

TSURUGI Inc. provides purchasing and export assistance services for heavy equipment and marine vessels located in Japan. We act solely as a purchasing and export representative on behalf of the client. TSURUGI Inc. does not sell equipment from inventory and does not provide direct auction access.

2. Equipment Source

All equipment and vessels are purchased from third-party sellers, including auctions, dealers, private or corporate sellers. TSURUGI Inc. is not the owner or manufacturer of the equipment unless explicitly stated in writing.

3. Client Responsibility

The client is responsible for:

  • Confirming model, specifications and intended use
  • Approving bidding or purchase decision
  • Verifying import regulations in destination country
  • Paying agreed service fees and purchase amount

All purchases are made only after client approval.

4. Condition & Inspection

Equipment is purchased based on information provided by the seller or auction. While TSURUGI Inc. may assist with listing translation, additional photos (when available), basic condition confirmation, or arranging third-party inspection (upon request), TSURUGI Inc. does not guarantee condition, performance, future functionality or suitability of the equipment. All used equipment is sold “as-is, where-is” by the seller.

5. Pricing & Payment

Total price may include:

  • Purchase price
  • Auction or dealer fees
  • Inland transport
  • Service fee
  • Export handling
  • Shipping cost (FOB or CIF)

Full payment must be received before export procedures begin unless otherwise agreed in writing.

6. Shipping & Export

TSURUGI Inc. arranges inland transport, port handling, export documentation, container loading or RoRo shipping, and cargo insurance (if requested). Risk transfers according to agreed Incoterms (e.g., FOB, CIF).

7. Import Regulations

The client is fully responsible for import permits, duties and taxes, and compliance with destination country regulations. TSURUGI Inc. is not responsible for import refusal, customs delay, or additional charges in the destination country.

8. Cancellation & Refund Policy

Once bidding or purchase has been confirmed and executed, cancellation is not possible. Auction purchases are final. Service fees related to completed work are non-refundable.

9. Limitation of Liability

TSURUGI Inc. shall not be liable for:

  • Mechanical failure after shipment
  • Hidden defects not disclosed by seller
  • Delays caused by shipping lines, ports, customs or force majeure
  • Losses resulting from incorrect information provided by the seller

Liability is limited to the amount of service fee paid to TSURUGI Inc.

10. Agreement

By engaging TSURUGI Inc. to purchase and export equipment, the client agrees to these terms.
