This agreement outlines the relationship between the Client and TSURUGI Inc. regarding participation in Japanese auto auctions. By submitting a bidding request and paying the required deposit, the Client agrees to the following:
1. Role of TSURUGI Inc.
TSURUGI Inc. acts strictly as a purchasing and export agent. TSURUGI:
- Provides access to Japanese dealer-only auctions
- Translates and explains auction inspection sheets
- Places bids on behalf of the client
- Arranges domestic transport
- Prepares export documentation
TSURUGI does not manufacture, modify, or guarantee vehicle condition unless optional services are separately requested.
2. Auction Condition Disclaimer
All vehicles are sold based on auction inspection sheets prepared by the auction house. Auction grading and comments are issued by the auction, not by TSURUGI Inc. The Client acknowledges that vehicles are generally sold “as-is” and accepts the condition as described in the auction documentation.
3. Binding Nature of Bids
Once a vehicle is successfully won at auction, the purchase is legally binding. Cancellation may result in financial penalties imposed by the auction house.
4. Payment Obligations
The Client agrees to complete full payment within the auction’s required deadline. Failure to complete payment may result in:
- Loss of deposit
- Auction penalties
- Additional administrative costs
5. Limitation of Liability
TSURUGI Inc. shall not be held liable for:
- Mechanical issues not disclosed by the auction
- Undetected prior repairs
- Delays caused by shipping companies or customs authorities
- Import regulations of the destination country
6. Governing Law
This agreement shall be governed by the laws of Japan.
